If application form is submitted and the starting fee is not paid by 31. 07. 2024, the organizer is entitled to collect from the participant specified in clause 1 a cancellation fee in the amount of 50 % of the total starting fee. The participant is obliged to pay the due amount to the race organizer within three business days from the receipt of the written notice.

Binding effect of the application form
By filling in this application form and sending it to the race organizer by e-mail: horakova@enginegroup.cz, the sending person accepts the proposal of the race organizer to participate in the race and the contractual terms related thereto on behalf of all persons specified in this application. All participants are obliged to comply with all terms and obligations set forth in this application and the roadbook provided by the race organizer.   

The race organizer has a right to reject the delivered application to the race. The application can be rejected, inter alia, due to a maximum number of participants being already registered, or due to the unsuitability of racing car for the participation in the race, or for the other reason. The race organizer shall inform the applicant on the rejection of the application and the paid starting fee shall be returned.  

Any potential disputes arising between the race organizer and the applicants and participating persons, and the accompanying persons shall be resolved the Czech courts in accordance with the applicable laws of Czech Republic. The competent court shall be the court pursuant to the seat of race organizer in all cases, unless the applicable law does not provide for this possibility. 

Cancellation terms:
Written cancellation of participation at the PCC 2023 without a cancellation fee is possible until 31. 07. 2024 by its delivery to email: horakova@enginegroup.cz.
In the case of cancelation of participation from 01. 08. – 20. 08. 2024 the cancellation fee is 50% of the total starting fee.
In the case of cancelation of participation from 21. 08. (inclusive) – 14. 09. 2024 the cancellation fee is 100% of the starting fee. The same applies in cases when the competitor fails to arrive at the start or fails to complete the race for any reason, or ends the race before the standard race end time. The race organizer recommends that you conclude insurance to cover a potential cancellation fee!

Disclaimer and notice of possible change:
The organizer reserves the right to make changes required by unexpected conditions. The organizer is entitled to potentially refuse the application with regard to the limited capacity of the race.

Exemption clause (Liability exemption clause):
The race organizer is explicitly exempt from liability for injury and material or financial damages incurred by race competitors, accompanying persons, owners of cars and third parties. This clause also applies towards team members and assistants. Drivers and owners of cars accept liability towards third parties in compliance with the relevant legislation, especially not the threaten the safety of the race participants, accompanying persons, visitors, other person involved in the race as well as third parties including other road users, all in accordance with Czech legislation. The race organizer does not arrange for any insurance of the persons participating on the race.

The race participants are aware that the race is taking place on the routes determined by the race organizer in advance and that they are obliged not to leave these routes without due reason. The race is taking place during standard traffic on the public roads and the roads are not exclusively closed for the race. The participants are obliged to comply with applicable Czech legislation, instructions of the race organizer given on the distance or at the site. In case of repeated breach or gross breach of instructions or rules of the race the race organizer has a right to immediately expel the participant from the race without providing any compensation. 

In a case of accident, the participants shall comply with the traffic regulations, especially to take all necessary steps to avoid further damage and to mark duly the place of the accident and inform the Police and race organizer without undue delay.

The participants are also legally liable for any breach of traffic regulations in the Czech Republic (in countries through which the race passes). Participants are responsible for the technical condition of their vehicles and obtaining of all the necessary insurance.

GDPR rules compliance:
Personal data provided in context of this application, are processed and stored by the organizer of the rally strictly for purposes of the race organization, the evidence of participating persons, obtaining of accommodation and related communication and accounting and/or legal agenda. The obtained personal data are not handed over outside of the European Union. The data controller does not appoint the data protection officer and it is not obliged to make so. 

The personal data are processed for the period necessary for the race organization and the period during which the parties can rise their mutual claims (especially taking into account the relevant statutory bar periods). Following this period, the data are kept for the necessary period to comply with archival obligations under statutory and internal rules. The data subjects have rights against the data controller specified under the General Data Protection Regulation no. 2016/679 (GDPR), especially Section 15 to 22 of the Regulation. These rights can be asserted at the race organizer at the below contacts. The supervising body to which the complaint on the breach of rights of data subject can be brought is the Office for Personal Data Protection, ID. No. 70837627, with its seat in Prague.  

Picture, video and sound documentation will be taken during the race. The participants of the race agree to their taking and declare that all the documentation, including video and sound documentation with them and their voice can be used by the race organizer for the purpose of race and race organizer marketing activities as well as for the public presentation of the race and informing related thereto (including uploading of documentation publicly accessible websites of the race organizer and presentation in other medias).  

By sending / signing of this binding application I agree with conditions and rules of PCC 2023 rally as well as with its roadbook and declare that I have filled the form correctly and completely. Furthermore, I agree with processing of my personal data by the organizer ENGINE PRAGUE s.r.o.in compliance with valid GDPR rules, Section 6 paragraph 1 letter b), c) and f) of GDPR for the above specified purpose. 

In the event of any variances or ambiguities between the Czech and English version of this application, the Czech version shall always prevail.
